By checking this box and booking an appointment with Show Digital, you agree to the following Terms & Conditions:

1. Property Readiness

To ensure a smooth photoshoot, the Client must have the property in a picture-ready state upon Show Digital’s arrival—this means clean, staged, and free of clutter, with all desired arrangements in place. Show Digital will not wait for last-minute adjustments, such as moving items, furniture, or cleaning. All preparations must be completed prior to the scheduled appointment time. If readiness issues prevent timely access, refer to the Late Arrival Policy in Section 4 for details on potential rescheduling or fees.

2. Creative Direction & Style

By booking, the Client acknowledges familiarity with Show Digital's portfolio, as showcased on our website and Instagram, and requests services in that artistic style. All deliverables are creative in nature and may vary from previous work to best capture the property's unique features. Show Digital reserves the right to make artistic decisions at its discretion. Content will not be rejected based on personal taste or aesthetic preferences.

3. Cancellations & Rescheduling

Cancellations or rescheduling must be made at least 24 hours in advance. Show Digital reserves the right to cancel or reschedule any confirmed appointment with prompt notice to the client. The following fees apply for last-minute changes:

  • Within 24 hours: 25% of the appointment fee

  • Within 3 hours: 50% of the appointment fee

4. Late Arrival Policy

If the client or property contact is more than 15 minutes late to the scheduled appointment and access to the property cannot be gained, Show Digital reserves the right to cancel or reschedule the shoot. Late arrivals may be subject to a cancellation or rescheduling fee.

5. Special Requests

If you have special requests (e.g., capturing garages, closets, unfinished spaces, etc.), please notify us either in advance or on-site at the time of the appointment. These areas are not typically included unless specifically requested.

6. Weather Policy

Shoots proceed as scheduled in daylight and overcast conditions, including light drizzle. In the event of heavy rain, clients may reschedule at no additional cost. If timing is critical, we can photograph interiors and return for exteriors on a clearer day—also at no extra cost.

7. Turnaround Time

  • Photography packages: Delivered the next business day

  • Video packages: Delivered within 48 business hours
    Expedited turnaround may be available upon request for an additional fee

8. Travel Fees

A travel fee of $1.25 per round-trip mile applies to any property located more than 15 miles from Auburn University. Clients will be notified of any applicable travel charges prior to the appointment.

9. Content Delivery

Final content will be delivered via an online gallery with options to download both full-resolution and MLS-optimized versions.

10. Payment Terms

All content will remain locked for download until full payment is received. Licensing and usage rights are not granted until payment is complete.

11. Copyright & Licensing

All content created by Show Digital remains the sole and exclusive intellectual property of Show Digital and is protected under United States Copyright Law (Title 17, U.S.C.). No rights are transferred to the client unless otherwise stated. By booking a service, the client is granted a limited-use license based on the selected package.

Definitions

  • Active Listing Period: The duration during which the property is officially listed for sale through a formal agreement, such as with a real estate agent or multiple listing service (MLS).

  • Active Rental Period: The duration during which the property is officially marketed for long-term rental through a formal agreement, such as with a property manager or listing platform.

  • Home Design: The architectural design, layout, and structural features of the home or property as captured in the photographed content.

  • Client’s Brand: The official branding, trademarks, or identifiers associated with the builder, developer, brand representative, or other entity who booked the service.

  • Ongoing Brand Marketing: Continuous promotional activities to enhance the visibility and reputation of the client’s brand, excluding direct property sales or rentals unless explicitly permitted under MLS Listing Use.

General License Terms

All licenses granted under this section are non-exclusive and non-transferable. Content may not be resold, sublicensed, or transferred to other agents, properties, platforms, or third parties without prior written consent from Show Digital. Show Digital retains the right to use, display, and resell the content unless otherwise agreed in writing. Licenses are specific to their intended use and may not be applied to other categories (e.g., using a Rental License for sales marketing) without purchasing an upgrade or separate license. Unauthorized use may result in license revocation and legal action.

Listing License
 A license is granted to the booking real estate agent.

Permitted Uses
 Content may be used solely to market the sale of the specific property photographed, during its active listing period.

MLS Listing Use
Granted Rights: Full rights for MLS listings of the specific property.

Restrictions: Use for agent branding, reuse for future listings, or transfer to other agents, brokerages, vendors, or platforms is not permitted.

Expiration: This license expires once the listing agreement ends or the property is sold, whichever comes first.

Additional Notes on Furnished & Model Homes:
 Photography of furnished or model homes is licensed under the Listing License only when presented alongside photography of specific, currently-available homes. Use of model home imagery on its own, or to market the community, future builds, or as a general branding asset, requires a separate Model Home/Branding License.

Rental License
 A license is granted to the property owner or property manager.

Permitted Uses
 Content may be used solely to market the long-term rental of the specific property photographed.

MLS Listing Use
Granted Rights: None.

Additional Notes:
 Rental packages do not include usage rights for MLS listings. If the property is later listed for sale, or if photos are shared with a Realtor or brokerage for listing purposes, a separate Listing Package license must be purchased.

Restrictions: Use for resale, builder marketing, unrelated properties, or agent branding is not permitted.

Expiration: This license remains valid for as long as the property is in its active rental period and under the ownership or management of the original client.

Branding License
 A license is granted to the builder, developer, or brand representative.
 This package is intended for builders, developers, or individuals who wish to use the content primarily for brand marketing purposes and to showcase a specific home design across a limited number of homes.

Permitted Uses
 Content may be used for ongoing brand marketing, including:

  • Website and social media

  • Sales brochures and print materials

  • Digital and print advertising

  • Showcasing the home design in promotional materials

MLS Listing Use
Granted Rights: Usage rights for MLS listings of up to five (5) homes built with the same home design.

Conditions: Each listing must be under the client’s brand or listed by an agent hired by the client specifically for those homes.

Additional Notes:
 This is intended for small-scale use and maintaining brand consistency across a limited number of homes. Use of the content to MLS-list more than five (5) homes built with the same home design requires upgrading to a Model Home Package.

Restrictions: Use by unaffiliated third-party agents or for unrelated listings is not permitted without written consent.

Expiration: This license remains valid in perpetuity for ongoing brand marketing purposes, provided the content is used in accordance with the terms herein. MLS listing rights expire if the conditions for use (e.g., same home design, client affiliation) are no longer met.

Model Home/Community License
 A license is granted to the builder, developer, or brand representative.
 This package is intended for builders and developers who plan to use the content at scale to market multiple homes built with the same home design, ensuring consistent branding and efficient marketing across a high volume of listings.

Permitted Uses
 Content may be used for ongoing brand marketing, including:

  • Website and social media

  • Sales brochures and print materials

  • Digital and print advertising

  • Showcasing the home design in promotional materials

  • Sales office displays, signage, and other promotional materials

MLS Listing Use
Granted Rights: Granted rights vary based on the package selected, generally including usage rights for MLS listings of more than five (5) homes built with the same home design.

Conditions: Each listing must be under the client’s brand or listed by agents hired by the client specifically for those homes.

Additional Notes:
 This is intended for large-scale use and marketing multiple builds of the same home design.

Restrictions: Use by unaffiliated third-party agents, for unrelated listings, or for other home designs is not permitted without prior written consent.

Expiration: This license remains valid in perpetuity for ongoing brand marketing purposes, provided the content is used in accordance with the terms herein. MLS listing rights expire if the conditions for use (e.g., same home design, client affiliation) are no longer met.

12. Unauthorized Use

Any use outside the scope of the purchased license — including reproduction, transfer, or sharing with unaffiliated parties — constitutes copyright infringement and may result in legal action.

All licensing matters, copyright claims, and disputes arising from unauthorized use shall be governed by the laws of the State of Alabama. The proper venue for any legal proceedings shall be in Lee County, Alabama.

13. Limited Liability

While all reasonable care will be taken during the shoot, Show Digital is not liable for accidental damage to property, missed shots due to access issues, or technical malfunctions outside of our control. In the rare event of equipment failure or content loss, liability is limited to a full refund or a rescheduled shoot at no additional charge.

14. Marketing Consent

By booking, you grant Show Digital permission to use any media created during the appointment for promotional purposes, including use on websites, social media, and printed materials. If you prefer your content not be used for marketing purposes, please notify us in writing before your scheduled appointment.
