Show Digital Terms & Conditions
By checking this box and booking an appointment with Show Digital, you agree to the following Terms & Conditions:

  1. Property Readiness
    To ensure a smooth photoshoot, the Client must have the property in a picture-ready state upon Show Digital’s arrival — this means clean, staged, and free of clutter, with all desired arrangements in place.
    Show Digital will not wait for last-minute adjustments, such as moving items, furniture, or cleaning. All preparations must be completed prior to the scheduled appointment time. If readiness issues prevent timely access, refer to the Late Arrival Policy in Section 4 for details on potential rescheduling or fees.

  2. Creative Direction & Style
    By booking, the Client acknowledges familiarity with Show Digital's portfolio, as showcased on our website and Instagram, and requests services in that artistic style.
    All deliverables are creative in nature and may vary from previous work to best capture the property's unique features. Show Digital reserves the right to make artistic decisions at its discretion. Content will not be rejected based on personal taste or aesthetic preferences.

  3. Cancellations & Rescheduling
    Cancellations or rescheduling must be made at least 24 hours in advance. Show Digital reserves the right to cancel or reschedule any confirmed appointment with prompt notice to the client.
    Fees for last-minute changes:
    Within 24 hours: 25% of the appointment fee
    Within 3 hours: 50% of the appointment fee

  4. Late Arrival Policy
    If the client or property contact is more than 15 minutes late and access to the property cannot be gained, Show Digital reserves the right to cancel or reschedule the shoot. Late arrivals may be subject to a cancellation or rescheduling fee.

  5. Special Requests
    If you have special requests (e.g., capturing garages, closets, unfinished spaces, etc.), please notify us in advance or on-site at the time of the appointment. These areas are not typically included unless specifically requested.

  6. Weather Policy
    Shoots proceed as scheduled in daylight and overcast conditions, including light drizzle.
    In the event of heavy rain, clients may reschedule at no additional cost. If timing is critical, we can photograph interiors and return for exteriors on a clearer day — also at no extra cost.

  7. Turnaround Time
    Photography packages: Delivered the next business day
    Video packages: Delivered within 48 business hours
    Expedited turnaround may be available for an additional fee

  8. Travel Fees
    Travel is charged as a flat rate based on your location. Your exact travel fee is shown clearly at checkout when you book.

  9. Content Delivery
    Final content will be delivered via an online gallery with options to download both full-resolution and MLS-optimized versions.

  10. Payment Terms
    All content will remain locked for download until full payment is received. Licensing and usage rights are not granted until payment is complete.

  11. Copyright & Licensing
    All content created by Show Digital remains the sole and exclusive intellectual property of Show Digital and is protected under U.S. Copyright Law.
    No rights are transferred to the client unless otherwise stated. By booking, the client is granted a limited-use license based on the selected package.

Definitions
Active Listing Period: Duration the property is listed for sale.
Active Rental Period: Duration the property is marketed for long-term rental.
Home Design: Architectural design and layout as captured.
Client’s Brand: Branding, trademarks, or identifiers of the booking party.
Ongoing Brand Marketing: Continuous promotional activities to enhance the client’s brand (not direct property sales or rentals unless explicitly permitted).

General License Terms
Licenses are non-exclusive and non-transferable. Content may not be resold, sublicensed, or transferred without written consent.
Show Digital retains the right to use, display, and resell the content unless otherwise agreed. Licenses are specific to their intended use. Unauthorized use may result in license revocation and legal action.

Listing License
Granted to the booking real estate agent.
Permitted Uses: Marketing the sale of the specific property during its active listing period.
MLS Listing Rights: Granted for the specific property.
Restrictions: Not for agent branding, reuse, or transfer.
Expiration: Ends when the listing agreement ends or the property is sold.
Notes: Furnished/model homes require a separate license for community/brand marketing.

Rental License
Granted to the property owner or manager.
Permitted Uses: Marketing the long-term rental of the specific property.
MLS Listing Rights: None.
Restrictions: Not for resale, builder marketing, unrelated properties, or agent branding.
Expiration: Valid for the active rental period under the original client.

Branding License
Granted to the builder, developer, or brand representative.
Permitted Uses: Ongoing brand marketing, including:
• Website and social media
• Sales brochures and print materials
• Digital/print advertising
• Showcasing the home design in promotional materials
MLS Listing Rights: Up to 5 homes of the same design under client’s brand.
Expiration: Perpetual for brand marketing; MLS rights expire if conditions are no longer met.

Model Home/Community License
Granted to the builder, developer, or brand representative.
Permitted Uses: Large-scale ongoing brand marketing, including:
• Website and social media
• Sales brochures, advertising, and signage
• MLS listings of more than 5 homes of the same design under client’s brand
Expiration: Perpetual for brand marketing; MLS rights expire if conditions are no longer met.

  1. Unauthorized Use
    Any use outside the scope of the purchased license constitutes copyright infringement and may result in legal action.
    All disputes are governed by the laws of Alabama, with venue in Lee County.

  2. Limited Liability
    Show Digital is not liable for accidental damage, missed shots due to access issues, or technical malfunctions beyond our control.
    In case of equipment failure or content loss, liability is limited to a refund or reshoot.

  3. Marketing Consent
    By booking, you grant Show Digital permission to use any media created during the appointment for promotional purposes.
    If you prefer your content not be used for marketing, notify us in writing before your appointment.
